Implementation Context

Given the context of maritime spatial planning as a field of activities where regulation and implementation are being reassessed from the terrestrial side, it became obvious that there are a number of uncertainties, obscurities and gaps that need filling. From this a catalogue of proposals for the further development of this area of regulation and planning activity was derived, a catalogue that confines itself to the essentials and that can be delineated in the form of summarised proposals.

Aspects / Objectives

  • Systematic Analysis of legal, economic and environmental aspects in the German EEZs and the Territorial Waters;
  • Contribution to the further development of a maritime spatial planning law to support the necessary regulation of infrastructure in maritime areas
  • Integrating multiple stakeholder perspectives and ICZM into MSP;
  • Facilitating the implementation of the international, European and national legal instruments.

Method

А main working tool for the development of the catalogue of suggestions was a desk-analysis of the following issues:

  • Economic and environmental interests in the marine area;
  • International, European and German legal framework;
  • Existing spatial plans in the Territorial Waters and EEZs of Germany;
  • The link to Integrated Coastal Zone Management.

Based on these outputs recommendations for further evaluations and developments of maritime spatial planning have been drawn.

  • Analysis of existing status of European and German maritime spatial laws and related laws
  • A catalogue of proposals for the further development of regulation and planning activity in the maritime area (international law, European law, German law)
  • Suggestions for increased collaboration between neighbouring countries to satisfy European requirements as to territorial cohesion
  • Suggestion how to minimise fragmentation effects and how to promote co-use of areas

Transferability

The results of the analysis, especially the suggestions for the continued development of spatial planning and spatial planning law can be transferred to other European maritime areas although some aspects are already out-dated as the study is from the year 2013.
